are, pursuant to Art. 4 No. 7 of the EU General Data Protection Regulation ("GDPR"), responsible for the processing of personal data of you as a user of the websites accessible at www.k4s.de (hereinafter also "website"), as our applicants, customers, suppliers as well as other persons with whom we communicate ("you").

(2) In the following, we would like to inform you in detail about the processing of your personal data (see section 2)

  • as our candidates or customers or as other persons with whom we communicate in the context of our personnel consulting and placement (see section 3)
  • as our suppliers, service providers and/or providers of other deliveries and/or services (see section 4)
  • as visitors to our website (see section 5) . We inform you about your rights regarding the processing of your personal data under section 6.

General information on the processing of your personal data

(1) Personal data is any information about an identified or identifiable natural person. Accordingly, personal data is all information that can be directly or indirectly assigned to your person, such as your name, address, telephone number or e-mail address.

(2) Personal data will only be processed by us if and insofar as

  • you have given us your consent to data processing for one or more specific purposes (Art. 6 para. 1 subpara. 1 lit. a GDPR);
  • the processing is necessary for the performance of a contract to which you are a party or for the performance of pre-contractual measures taken at your request (Art. 6 para. 1 subpara. 1 lit. b GDPR);
  • the processing is necessary for compliance with a legal obligation to which we are subject (Art. 6 para. 1 UAbs. 1 lit. c GDPR); or
  • the processing is necessary for the protection of our legitimate interests or those of a third party, except where such interests are overridden by your interests or fundamental rights and freedoms which require the protection of personal data (Art. 6 para. 1 UAbs. 1 lit. f GDPR).

(3) We will inform you in the following provisions of this data protection declaration which of the legal bases mentioned in paragraph 2 we base the processing of your personal data on in individual cases.

(4) In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly monitored. In addition, we may pass on your personal data to third parties if contracts or similar services are offered by us together with partners. You will receive more detailed information on this when you provide your personal data or in the following provisions of this privacy policy. If our service providers or partners are based in a country outside the European Economic Area (EEA), we will also inform you about the effects of this circumstance in the following provisions of this data protection declaration.

(5) A transfer of your personal data to countries outside the European Union or the European Economic Area (third countries) does not take place. Should this nevertheless be the case, we will inform you of this in this data protection declaration or separately in individual cases.

(6) You are under no contractual or legal obligation to provide us with personal data. However, without the processing of your personal data, we are generally not able to provide our service in relation to you or your employer/client.

(7) Automated individual case decisions or profiling measures do not take place.

Suppliers/service providers

(1) If you are a supplier or service provider of ours, in addition to information about your company, we also process information about you personally (e.g. contact data) or about other persons within your company. Your personal data is essentially collected directly from you (e.g. through orders) or in the course of processing by us, insofar as this is necessary for the implementation of the business relationship. In the event of a change of contact persons in your company, there may also be a new collection of personal data in connection with employees of your company.

(2) Your data will be stored and processed electronically primarily for the purpose of processing the contract between us and you. For communication within the scope of contract processing (e.g. offers, orders, order confirmations, delivery bills and/or invoices), we may contact you via the data collected from you. This can be done via postal address(es), e-mail address(es) or telephone and fax number(s). The technical and content-related processing of contracts, in particular content, specifications and prices, can also be processed via the stored data. The legal basis for this is Art. 6 para. 1 UAbs. 1 lit. b GDPR.

(3) Provided that no legal or contractual retention periods prevent deletion, your personal data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected. This is usually the case when there is no longer a business relationship with your company or you have left the company as a contact person.

(2) If you are of the opinion that the processing of your data violates data protection regulations, you also have the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR. Please contact a supervisory authority in the member state of your residence, workplace or the location of the alleged violation.
